Montana Senate Bill 29

Main points of SB 29: Mandatory Training for Sellers and Servers of Alcohol:

  • All servers and sellers of alcohol must be trained
  • Training must be completed within 60 days of new hire, and every three years thereafter
  • Employer must maintain records of training, and certify annually upon license renewal that they are in compliance
  • Volunteers are not required to have training (Brewfests, rodeos, 4th of July, etc)
  • Alicensee found to be out of compliance may be fined $50.00 for the first offense, $200.00 for the second and 350.00 for the third violation in a three year period
  • The department shall consider mitigating circumstances such as  prior history, good faith efforts to prevent a violation, written policies concerning employee conduct, and if the violation was discovered as part of a compliance check, or sting operation
  • Jurisdiction. The implementation and enforcement of any mandatory server and sales training programs in this state is under the exclusive authority and jurisdiction of the department of revenue

  • ServSafe and TiPS maintain secure data bases so record keeping for employee training is problem free
